Acceptance of these terms
These Terms of Use ("Terms") govern your use of the website operated by ThinkVision Consulting of Florida LLC ("ThinkVision," "we," "us," or "our") (the "Site"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
Purpose of the Site
The Site provides general information about ThinkVision and the services we offer, including training, sales strategy, process optimization, business photography and videography, and freelance writing. Using the Site or booking an introductory meeting does not create a client relationship. Any engagement with ThinkVision is governed by a separate written agreement, proposal, or statement of work, which controls if it conflicts with these Terms.
No professional advice
Content on the Site is for general informational purposes only. It is not legal, tax, accounting, financial, or investment advice, and it is not a substitute for advice tailored to your business. You should consult qualified professionals before making decisions based on anything you read on the Site.
Results and metrics
Client engagement figures, initiative counts, and other metrics shown on the Site describe ThinkVision's past work as of the period stated. They are not a promise or guarantee of any particular outcome. Business results depend on many factors outside our control, and your results may differ.
Intellectual property
The Site and its content, including text, photographs, video, graphics, the ThinkVision name and logo, and the layout of the Site, are owned by or licensed to ThinkVision Consulting of Florida LLC and are protected by copyright, trademark, and other laws.
You may view and print pages of the Site for your own personal, non-commercial use. You may not copy, download, reproduce, modify, distribute, or publicly display any Site content, including portfolio photography and video, without our prior written permission.
Client names and logos
Client names and logos displayed on the Site are the trademarks of their respective owners. They are shown to identify organizations ThinkVision has worked with, and their display does not imply that those organizations endorse ThinkVision or the Site.
Acceptable use
When using the Site, you agree not to:
- use the Site for any unlawful purpose or in violation of these Terms;
- attempt to gain unauthorized access to the Site, its servers, or any connected system;
- introduce viruses, malware, or other harmful code;
- scrape, harvest, or collect content or data from the Site by automated means; or
- interfere with the Site's operation or with anyone else's use of it.
Third-party links and services
The Site links to services we do not operate, including Microsoft Bookings for scheduling meetings. Those services are governed by their own terms and privacy policies. We are not responsible for their content, availability, or practices.
Disclaimer of warranties
THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ITS CONTENT IS COMPLETE OR CURRENT.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THINKVISION CONSULTING OF FLORIDA LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
This section applies to your use of the Site only. Liability for paid services is governed by your written agreement with ThinkVision.
Indemnification
You agree to defend, indemnify, and hold harmless ThinkVision Consulting of Florida LLC and its members, officers, employees, and contractors from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.
Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of those courts.
General terms
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with the Privacy Policy, are the entire agreement between you and ThinkVision about your use of the Site.
We may update these Terms at any time by posting a revised version on the Site with a new effective date. Continuing to use the Site after changes are posted means you accept the revised Terms.
